Your Rights Under The TCPA
The TCPA places several key restrictions on telemarketers to protect your privacy and peace. They include:
- Calling hours: Telemarketers can’t call you outside the hours of 8 a.m. and 9 p.m. local time.
- Consent requirement: They must have your prior express consent to call you.
- Do-not-call compliance: Telemarketers must honor the National Do Not Call Registry. If your number is listed there, they are generally barred from calling you.
- Caller identification: They must provide their name, the name of the business or organization they represent, and a contact number or address for that entity.
Robocalls – that is, automated phone calls that deliver a recorded message – are also regulated under the TCPA. Here are the key points you need to know:
- Prior express consent: Robocallers must have explicit permission to contact you using prerecorded messages or automated systems.
- Opt-out mechanism: Every robocall should provide an easy way for you to opt out of receiving future calls.
- Revocation of consent: You have the right to withdraw your consent at any time, in any reasonable way, and the robocaller must honor your decision.
