The Washington Insurance Fair Conduct Act (IFCA) protects policyholders from these unfair practices by giving them a right to legal action and compensation.

Understanding Your Rights Under IFCA
As a policyholder, you have specific rights that your insurer must respect. They include:
- Prompt and reasonable investigation: Insurers must investigate any claim you file within 30 days. Their investigation must be fair, reasonable and based on all the available information.
- Claim denials: If your insurer denies your claim, they must have adequate grounds for doing so. They must point out the specific policy provision, condition or exclusion that justifies the denial.
- Accurate policy representations: Insurers can’t misrepresent or make false promises about the terms of their policies, including coverages and exclusions.
- Duty to defend or indemnify: If you get sued in situations that fall within the scope of your policy, your insurer may have a duty to defend or indemnify you under the terms of your policy.
- Uncontested UIM benefits: Insurers can’t refuse to pay undisputed underinsured motorist (UIM) benefits if you have that coverage.
If your insurer violates any of these rights, you may have the grounds to sue for compensation and potentially receive additional financial penalties – up to three times the amount of actual damages. Note that these protections do not extend to health insurance claims.
